Under Australia’s Marriage Act 1961 and Marriage Regulations 1963, non-Australian citizens can marry in the country and that marriage is deemed legal and binding internationally. The couple, both at least 18 years old and unmarried, will have to meet with a marriage celebrant to discuss the details of their special day. The celebrant will require documents from them, such as their birth certificates and passports, as well as a filled out Declaration by Party to Proposed Marriage form, which the celebrant provides.
If they have been married before to someone else, they must show either the Divorce Decree Absolute certificate to prove that their prior marriage is not valid anymore or the death certificate of the former spouse if applicable.
Just as required of Australian citizens, Singaporeans and other foreign citizens need to submit a Notice of Intended Marriage (NOIM) at least one month prior to the wedding date but not more than 18 months to the celebrant. After the wedding, the celebrant will then lodge the documents with the Registry of Births, Deaths and Marriages in the state where it was held.
The couple can communicate with the celebrant before the wedding by phone, email, web chat or fax as long as they have already submitted the NOIM form on time. But of course, they need to meet in person in Australia on their wedding day. There must also be two witnesses of legal age. The couple will then receive an official Registry-issued Certificate of Marriage with either an Apostille or Authentication Stamp. The Department of Foreign Affairs and Trade performs both stamps.
